Introduction

These Terms of Service ("Terms") govern your use of the Simply Safeguarded website (www.simplysafeguarded.com) and all digital products, courses, memberships, and services offered by Simply Safeguarded, operated by Darci Lee Solutions Inc. ("we," "us," or "our"). By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our products.

1. Products and Services

Simply Safeguarded offers digital educational products including video courses, downloadable resources, printable materials, and membership programs related to scam awareness and digital safety for adults. All products are delivered digitally through our online platform.

2. Account and Access

When you purchase a product, you will receive access to the course materials through our platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Payment and Pricing

All prices are listed in US dollars unless otherwise stated. Payment is processed securely through our third-party payment processors (Stripe and/or PayPal). By providing payment information, you represent that you are authorized to use the payment method. We reserve the right to change pricing at any time, though any price changes will not affect purchases already completed.

For recurring membership products, you authorize us to charge your payment method on a recurring basis at the interval specified at the time of purchase until you cancel. You may cancel your membership at any time through your account settings or by contacting us at [email protected].

During the checkout process, you may be presented with additional product offers including order bumps and one-time upsell offers. These are optional. By clicking to add these products, you authorize an additional charge to the same payment method used for your original purchase. Each additional product is a separate purchase and is subject to these same Terms.

4. Refund Policy

We want you to be completely satisfied with your purchase. We offer refunds under the following conditions:

You must have accessed and engaged with the course materials. We do not offer refunds for non-use. If you experienced technical difficulties, you must have contacted our support team at [email protected] and given us a reasonable opportunity to resolve the issue. If after engaging with the materials and receiving any necessary technical support, you genuinely feel you did not learn anything of value, you may request a refund by emailing [email protected] with the subject line "Refund Request."

Refund requests must include a brief explanation of what you found lacking. We review all requests individually and aim to respond within 5 business days. Approved refunds will be processed to the original payment method within 10 business days.

For recurring membership products, cancellation stops future billing but does not entitle you to a refund of payments already processed.

5. Intellectual Property

All content provided through Simply Safeguarded, including but not limited to videos, text, graphics, printable resources, course materials, logos, and trademarks, is owned by Darci Lee Solutions Inc. and is protected by Canadian and international copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the materials for your personal, non-commercial use. You may print downloadable resources for your own personal use and share printable resources included in the Family Protection Pack with immediate family members as intended by the product.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or sell any of our content. You may not share your account login credentials with others or allow others to access your purchased content through your account. You may not use our content to create competing products or services.

6. Testimonials and User Content

By submitting a testimonial, review, or feedback, you grant us permission to use your submission in our marketing materials in accordance with our Privacy Policy. We may use your first name, last initial, and general geographic location alongside your testimonial. We will obtain your written consent (including email confirmation) before publishing any testimonial. You may request removal of your testimonial at any time.

7. Affiliate Relationships

Simply Safeguarded participates in affiliate marketing. We may recommend third-party products or services and earn a commission on purchases made through our affiliate links. These recommendations reflect our genuine opinions and are not influenced by compensation. We also work with affiliate partners who promote our products. Affiliates operate under their own terms and privacy policies.

Simply Safeguarded provides educational content related to scam awareness and digital safety. We make no guarantees regarding the results you may or may not experience from using our materials. While our products are designed to help you recognize and respond to scam attempts, we cannot guarantee that you will never encounter a scam, that you will never experience financial loss from fraud, that any specific outcome will result from applying what you learn, or that the information provided will be applicable to every situation you encounter. Your results depend on many factors including your individual application of the materials, the specific scam tactics you may encounter, and your personal circumstances. Testimonials and examples used in our materials represent individual experiences and are not intended as guarantees of similar results.

9. Limitation of Liability

To the maximum extent permitted by law, Darci Lee Solutions Inc. and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or savings, arising from your use of or inability to use our products, any scam or fraud you may experience regardless of whether you have used our materials, any actions you take or fail to take based on information in our products, or any interruption or cessation of our services.

Our total liability to you for any claim arising from these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Darci Lee Solutions Inc. and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our products, your violation of these Terms, or your violation of any rights of a third party.
